Mayor Jaime Capil of Porac, Pampanga, has officially moved to challenge a judicial ruling that upheld his dismissal from government service. The legal maneuver seeks to overturn a decision by the Office of the Ombudsman, which found the local chief executive guilty of gross neglect of duty regarding the oversight of a Philippine offshore gaming operator (POGO) within his jurisdiction.

The controversy centers on the operations of Lucky South 99, a POGO facility that authorities raided following allegations of human trafficking, torture, and various cybercrime activities. Investigators alleged that Capil failed to exercise proper regulatory authority and monitoring over the compound during its period of operation from 2021 to 2023.

Grounds for Dismissal and Perpetual Disqualification

The initial ruling against Capil cited “clear substantial evidence” of administrative lapses. Specifically, the Ombudsman noted that business permits were issued to the POGO firm despite a lack of mandatory requirements, such as a Letter of No Objection (LONO) from the local municipal council and proper registration with the Securities and Exchange Commission (SEC).

The penalties imposed on the mayor include removal from office, forfeiture of retirement benefits, and a perpetual disqualification from holding any future position in public office. While other local officials named in the initial complaint were cleared due to lack of evidence, the burden of administrative accountability was placed on Capil as the town’s chief administrator.

Impact on Local Governance and Re-election Bid

The legal dispute has created significant political friction in Porac. Despite the dismissal order issued in early 2025, Capil proceeded with his re-election campaign, ultimately securing the highest number of votes in the May midterm elections. However, the Commission on Elections (Comelec) later moved to disqualify him based on the Ombudsman’s findings, declaring votes cast for him as stray and ordering the proclamation of the runner-up.

Capil maintains his innocence, arguing that the administrative case is not yet final and that he is entitled to due process. “We have legal remedies under the law, and I am ready to fight for truth and justice,” Capil stated, emphasizing that he intends to exhaust all judicial avenues to reclaim his position and clear his name.

Current Status of the Appeal

The Mayor’s legal team is currently asking the Court of Appeals to reconsider its affirmation of the dismissal. They argue that the mayor cannot be held solely responsible for the clandestine criminal activities occurring within a licensed POGO’s private premises. Until a final, executory judgment is reached by the highest courts, the leadership of Porac remains a point of intense legal and political contention.
